Agreement to Terms
By downloading, accessing, or using Trail X Trail LLC apps, website, or services (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
What Trail X Trail Is (and isn’t)
- We provide offline base maps and tools to plan routes, record tracks, create custom waypoints, and share track packs.
- We do not provide tracks. Tracks and POIs are created and shared by riders. Availability, legality, and accuracy can vary and change.
Always verify conditions and access locally and follow applicable laws and land rules.
License and Account Use
- Personal License. We grant a revocable, limited, non‑exclusive, non‑transferable license to use the Service for your personal use.
- No Account Sharing. Your account and any paid entitlements are for a single user who controls the registered email or app‑store account. Do not share, sell, rent, or transfer access.
- Device Limits. Install on a reasonable number of your own devices (e.g., up to three active at a time). We may require re‑activation or limit additional devices.
- Anti‑Piracy / Distribution. Do not copy, extract, scrape, bulk export, mirror, redistribute, or build a competing service using our apps, APIs, or data.
- Enforcement. We may rate‑limit, suspend, or terminate accounts for sharing, circumvention, or misuse and revoke cached entitlements or block new activations.
Safety and Disclaimer
Trail X Trail is a navigational aid for reference only. It does not direct your conduct, grant access rights, or replace your judgment.
- Off‑road travel involves hazards (terrain, weather, wildlife, mechanical issues, limited connectivity). You assume all risks.
- Obey closures, signs, land use rules, and private property. If access is unclear or restricted, turn back.
- Do not interact with the device while moving. Stop first, or have a passenger operate the app.
- Maps, tracks, and waypoints may be incomplete, inaccurate, or unavailable. Verify conditions with official sources.
No Warranties. The Service is provided “as is” and “as available,” without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non‑infringement.
Your Content
- You own the tracks, waypoints, notes, and media you create.
- If you share content (e.g., public track packs), you grant Trail X Trail a worldwide, non‑exclusive license to host, display, and distribute that content within the Service.
- You must have rights to content you share and avoid unsafe, illegal, or infringing material. We may moderate or remove content that violates laws or policies.
- You may not resell or redistribute datasets or use them to build a competing product or service.
Third‑Party Services and No Emergency Use
- The Service may use third‑party basemaps, geocoders, or services subject to their terms; availability may change.
- Trail X Trail is not an emergency or safety service and is not a substitute for 911 or local emergency services. Do not rely on it for emergency communications.
- Do not use the Service for aircraft, marine, or other high‑risk activities where failure could lead to serious harm.
Subscriptions, Payments, and Refunds
- Pro features require a paid subscription. Purchases and refunds are handled by Apple App Store or Google Play under their policies.
- Subscriptions auto‑renew until canceled in your store account settings.
- Prices may change upon renewal with required notice. Chargebacks or fraud may revoke entitlements and suspend accounts.
Limitation of Liability; Indemnification
To the fullest extent permitted by law, Trail X Trail and its owners, contributors, and partners are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; or for lost profits, data, goodwill, or equipment, arising from or related to use of the Service. Our total aggregate liability for all claims will not exceed the greater of US $100 or the amounts you paid to Trail X Trail in the 12 months before the claim.
You agree to defend, indemnify, and hold Trail X Trail harmless from claims, damages, costs, and fees (including reasonable attorneys’ fees) arising from your use of the Service, your riding activities, your content, or your breach of these Terms or law.
Suspension and Termination
We may suspend or terminate access for violations, suspected abuse, fraud, piracy, or legal reasons. You may stop using the Service at any time by deleting the app and canceling your subscription.
Force Majeure
We are not responsible for failures or delays caused by events beyond our control, including natural disasters, government actions, connectivity issues, cyberattacks, or third‑party outages.
Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict‑of‑law rules. Venue and exclusive jurisdiction lie in the state and federal courts located in Virginia, USA.
No Class Actions. You and Trail X Trail waive any right to participate in class, consolidated, or representative actions. Claims must be brought in an individual capacity. If a term is found unenforceable, the remaining terms remain in effect.
Changes to These Terms
We may update these Terms as our products or laws change. We will post updates here and update the effective date. Continued use of the Service after changes means you accept the updated Terms.
